To start the process, we will need to know some basic information about your property. Please answer each question as accurately as possible. We will then review the information to determine if one of the mitigation water rights we represent can provide mitigation for your new use. You can begin the questionnaire by finding your property on our map by clicking here.

Purchase and Sale Agreement

Purchase and Sale Agreement

If your property can be mitigated by one of our clients’ water banks, we will send a Groundwater Mitigation Agreement. This is an agreement between you and the seller of the mitigation rights water. After you have reviewed and signed the agreement, we will send it to the seller for signature. Once fully signed, you will then deposit a 25% down payment into an escrow account.

Application to Department of Ecology

Application to Department of Ecology

When the deposit is received, we will prepare an application to the Department of Ecology on your behalf. We will send the application documents to you for review and signature, and then submit the documents to Ecology. Jessica Kuchan, the attorney who manages the water bank, will help to answer any questions or resolve issues that arise during Ecology’s review of your application.

Groundwater Mitigation Certificate

Groundwater Mitigation Certificate

Once an application is approved by Ecology, the parties will begin the closing process. The remaining funds come due and a Groundwater Mitigation Certificate will be recorded. For more information about the process to receive a Groundwater Mitigation Certificate, see our blog post.
